Canadian Office question. Please advice.

Hi Sir/ Madam,

Good Morning !!

I am a Permanent Resident of Canada. I mean, myself and my wife hold a PR card which was received 1 year ago. But i live in united states. 10 months back, i was blessed with a baby who is an united states ciitizen (holding a US passport). Since she was not at all born while i was processing the application, I didnt include her in my aplication and she is not a canadian PR. Now, i would like to apply PR for her (under the dependent sponsor category) and move to canada with my family. May i know the fees (with the breakage) that I am supposed to pay for my application  ?

Myself and my wife are from india. My baby was born in USA. Now we are living in USA on a temporary work visa. We may move back to india at any time as the recession has started in USA. When selecting the canadian office for processing, may i opt india or should i need to select only USA as my baby is a united states citizen ? Please advice.

The baby is a US citizen, she will be processed in Buffalo.

You must be residing in Canada in order to sponsor her as a PR, so either yourself or your wife has to go to Canada in order to do so.

Fees: Sponsor - $75.00
Principal Applicant under 22 (dependent child) - $75.00

Are you 100% sure on the below ?

1) Either myself or my wife should be physically present in canada to process my daughter's PR under sponsor category ?? If i apply for the dependent (baby's) PR residing in US or India, would my application get rejected ? please advice. I am upset, because i have to be seperated from my family (by living in canada) for 8-10 months to get my baby's PR processed.

OR what is the easiest way to go about it ? taking my baby on visitor visa ? in that case, she cannot use medical facility or go for school ? my head is spinning.

2) I can only select the buffalo office and cannot select india office ?? I am asking this question becoz, I will be moving back to india in 2 months. In that case, i need to send her passport to US (via postal or friends) for stamping and that is a big headache. Please advice.

If you are both Indian, the child will be Indian by descent right?

But as PR's you must be residing in Canada to sponsor the child. The only other alternative if you don't want to be seperated is to take the child to Canada with you as a visitor and apply then. And no, if she is a visitor she will have no health care or school. You will have to buy medical insurance. Buffalo processings times are upto 11 months, ND up to 6 months, but often both take much less time to complete processing.

The child is 10 months old - true, she is not eligible for school or medical care, but she wouldn't be going to school anyway. If you mean daycare, you'll only have to wait for less than a year for her PR, so the fees won't be too bad.

If it is your intention for your entire family to move back to India in 2 months, then sponsoring your child is impossible at this time.

You could always wait until you are ready to settle in Canada and then sponsor your child.  I don't understand why you'd want to get PR if you have no intention to live in Canada?

I agree. Its quite a troublesome process to go to if you don't plan to settle in Canada.

To the OP, also be aware that in order to keep your own PR status, you must be resident in Canada for 730 days in a 5 year period.

And since you've been gone for at least 10 months of the year since you applied, I can't see that you'll be able to qualify to keep your PR if you still don't intend to settle here, and plan on moving to India.

jayde is right. You say you got the PR card 1 year ago and are moving to India in 2 months. So you will need to back living in Canada in a maximum time of 22 months otherwise you and your wife will lose your own PR status.

Since she was born in United States, she has got a US Passport and US birth certificate. There is no indian passport or birth certificate issued by indian government. The only thing is we both (myself and my wife) are from India and she is our descent. Would that suffice to apply via NDelhi office ? We have taken visa for india to take her to india. So, do you still mean that........since myself and my wife are from india, we can select the canadian visa processing office as "India-New Delhi" ??

...........does this mean that I NO NEED to take any visa for my daughter for entering canada ? And, after reaching there I can apply for her PR under the sponsorship category ?

C) one more additional question....Since my daughter is a US citizen by birth and she holds a US passport, based on NAFTA agreement or something like that......is my daughter eligible to freely enter canada without any issues and use the medical facilities & go to school. Please advice.

..............Yeah, i understand your annoyance. Sorry friend. Defenitely i need to migrate to canada. I need a better life. Moreover, I have spent lot of money in getting my PR processed. I will not let it go wasted. It is the matter of time to get migrated / moved. I got stuck with my present job in US and also wanted to save some money before taking the move. Also, since getting a job in canada (without canadian experience) is difficult, thought of finding a way to get transferred directly from an indian employer to their facility in canada. By that I can have peaceful/ smooth migration. Lots of things are going on in my mind. I know, if a person is not serious about moving to canada and just like that applying for the PR will unnecessarily delay the processing time for a guy who is seriously looking to get migrated.

I assure that i will get migrated to Canada in the next 6-8 months. I am fed up of working for my current organization...they fry me like anything and take things for granted.

Your daughter is a citizen of the USA, so she can come to Canada without a visa. So you and your wife could come to Canada with her and apply for her PR then. Usually the border official wants proof the visitor will leave at the end of his or her stay, but with an infant they usually let them in with their parents.
The child's parents are both citizens of India. In some countries, this would mean the child is also a citizen of the parents' country, not just of the country of birth. So could you get an Indian passport for her, just based on the fact that her parents are Indian? If yes, then you could apply through New Delhi or Buffalo. If no, then you have to go through Buffalo.
