Can I apply for Sponsor/PR for my spouse from India

I am Mohan, I got PR in OCt 2007. I landed in canada in Nov 2007 and stayed for Month and came back to India. PR is valid till 2010.

Problem
My spouse doesnot have the PR. The reason is, I got the PR before I got married.

Question
Can apply PR for my wife from India, Is this possible or Do I have to apply from canada.

hey there,
from what I know , only a canadian citizen living outside canada can do a sponsorship for his wife, and he has to proove for the immigration that he will return canada as soon as his wife get the PR.
But since you are a PR, I guess that you have to be in canada,do some research over this forum, you will find the expert opinion.

from what I know , only a canadian citizen living outside canada can do a sponsorship for his wife, and he has to proove for the immigration that he will return canada as soon as his wife get the PR.

One question for the OP.  Did you get your PR visa, get married, then "landed" in Canada?  If you did, you cannot sponsor your wife, as she is no longer a member of the family class.  If you received your PR visa, "landed" and then returned to your country and got married, then once you return to Canada, you can submit a sponsorship and application for your wife.

-Also be cautious that you maintain your PR status, by staying 790 days (I guess) within a 5 year period.
- If you do not stay those days after being PR you may lose your PR status.

I applied for PR when I was single and got my PR visa after my marriage like 1 year after my marriage.

So it appears that you "landed" as a single person, when you were actually married and if never told CHC about the marriage or your wife didn't have a medical.  Well,then you blew it, you wife is no longer a member of the family class and cannot be sponsored.  You also misrepresented yourself when you "landed"  Time to hire a lawyer.

Ok, this is a notice for anybody who is about to make this mistake right now.  Too late for the Original poster unfortunately.

When your application is in process by CIC anywhere from the point of applying to landing as a PR and you have a change in family status like getting married, having a new baby etc., you must immediately inform CIC of your change in family status.  This is true even if you have already been issued the PR visa at that point and you just need to land.

It will delay your application to add the new person to your file but if you do not do this and instead you go and land in Canada as a PR without declaring this new person as a member of your family, you have committed fraud against immigration by misrepresenting your family status and you will be barred from ever sponsoring that person in the future.
