Author Topic: Buffalo said they transferred my file and now they said file is still in Buffalo  (Read 940 times)

Hi all. After requesting Buffalo to transfer my file to Brazil after 2 months for lack of proof of entering in the US legally for a period of 1 year, in my first e-mail from them, I was told they transfer it back to Sydney and if I had any other question I should contact Sydney. Now, After send them an inquiry and asking them when they transferred t to Sydney, they told my file was still in Buffalo under review regarding my request to transfer it to Brazil. What is going on? I did not want to withdraw it, but I am really thinking about it. I am thinking it could be a lot faster if I just withdraw and re-apply. Brazil has been quicker than Buffalo in processing my application.

What do you guys think?

It may be faster to do that if you don't mind applying without receiving your check first. Thats just my opinion.

Of course, you may find it would have been faster with letting buffalo do whatever (either send to Brazil or process it themselves), but it maybe faster just to go straight to Brazil visa office. It also depends on your PCC, and whether you are willing to get them again. Also someone on the forum said, CIO is going slower now.

I'll stay as it is now, re-apply will require more effort to do the paper work again and you may need IELTS and also get your PCC from USA again, if I'm not wrong you get your nomination from Alberta right? this is 70% of your case, think about that if you withdraw and start from scratch, there is no warranty that Brazil will be faster than Sidney.

Actually no. I do not have nomination from Alberta. I applied as skilled worker. Maybe Buffalo will make a decision soon, I am hoping. I just think it is taking to long(2 months) not to transfer, but to make a decison on that transfer.

Its hard to say. i think they will send it Brazil but when is the question.

I think, for me, my visa office would be faster than buffalo but the effort of PCC would be too much. Now, your FSW application is a worse position than mine, in the sense, they have to either send your application to brazil or they might return it to you. I don't mind mine going a bit slow because i am in no rush to leave the US. What is your trade-off? Are you in a hurry?

I strongly agree with Rupeshari.  It is really complicated and the best thing that we should do is to wait patiently.  At least you know where your position right now that your file is still in Buffalo and they are reviewing it.  I haven't heard from Manila nor Sydney or Buffalo. I know the waiting part is so frustrating but that's how it is.

Do you know what frustrates me is the fact that I have a friend who sent her application to Brazil and received medical request within a month of submitting the documents. It is not only her but three other friends. I guess I should be more patient since whatever has to happen, will happen.

Well, I took my IELTS on March 2009 and I think it should still be valid, right? As for my Police Certificates, I got mine here in the US  in February 2009. There I think I will have to get again, right? As for my Police Certificates from Brazil, they are the hard ones. I also got them In February 2009 and if I have to get them again, It will take me another 3 to 4 weeks. The rest are just collge transcripts, notarized employment letter that I can get another one, etc. I also heard that the applicant does not decide where he or she wants to have his or her application process. Sydney is the one who decides and usually they request you to send your documents to the country where you reside. Is that correct?

What do you think?

no, i think they only decide if an office is not applicable to you.

If you send from the US to Sydney requesting Brazil, as long as you are Brazilian, you would get it because how do they know that you live in the US as opposed to living in Brazil and visiting the US at the point when you sent in the application.

And what do think? Should I withdraw my application taking in consideration the IELTS I took in March 2009 and PCC  got in February 2009 from both from the US and Brazil?

if you are sure that they need to go through Sydney before it gets to Brazil, then it might be good to apply again because Sydney is nowadays taking 2 months to reply. The question is, if they transfer it to Sydney, will Sydney then get to your file quicker than other people's file or will it just go into the queue.

You would have to work out how long it would take through buffalo and through Brazil and see which one is quicker.

Here ae some info: Sydney is taking 2 months to reply now, Buffalo seems to be processing August applicants now on trackitt (not sure how accurate trackitt is).

It is kind of big decision to make. Another question is if Buffalo will refund my money. If Sydney is taking 2 months to reply and Buffalo might take another 2 months to make a decision on the transfer and not to transfer and nothing guarantees me that they will transfer it to Brazil. They still might transfer it back to Sydney and take another 2 months. Let me ask you something. If I re-apply to Sydney, can I still send my PCC I got in February 2009 and I will have to get another ones? I know that the IELTS will be valid but I am not sure if the PCCs will.

I think you would have to get new because they say, it shouldn't be longer than 3 months.

Buffalo should refund your money but you may not get it in time for your next application.

Also would buffalo cancel your application or will they send it to Sydney to cancel it (which may take a long time). I doubt they would send to sydney to cancel it but we don't know the process for sure.
