The case you are refering here from one of your fren is very obvious specially in Asian IT markets
in project management terms ( or I would say as you have refer PMI) this is called halo effect ( you did very well as programmer or systems analyst so we will promote you to manager, but did that person actually perform well in order to become PM.. anyways this topic is very subjective and not relevant here in prabhjot's thread..)

also PMI says 3500 to 4500 man hrs of project management exp... no IT person can have this exp in 5yrs overall ( when one has only 5 yrs IT exp) unless one is from b-school and joined as AM or PM,my idea here is just to highlight some points for madam prabhjot so that when she prepare her appeal she knows what could be the cross questions..

I would be more than happy to see how prabhjot carry her case and appeal, since I myself applied under NOC 0213. This case is surely a lesson learned

You may please contact the minister, write a cover letter, convince him that you was not assesed honestly, so there should be an enquiry of your case...that is NOT appeal, that is a "May Be" case opening...

I second Canada via USA.

Though I am not from IT field, I feel it is very difficult to prove that one is a Manager and not a Programmer in only 5 years experience, unless one have a management degree.
From what I can understand a manager apart from being technical sound has to manage finances of the dept/company manage a team or dept which shall include recruitment, apprisals, training and development of those individuals.

The average salary for such managers would be in 6 figures a month(not very sure though, just a guess).

So until Ms Prabjot have a salary which is average for managers, it will be very difficult for her to prove above job duties.

Though I wish all luck to Prabjot in her apeal.

I have to agree - Managerial responsibilities include an entire gamut of chores that don't figure in the regular programmer category.

Although, I do not think an MBA is required, i feel this is gauged by a conversation rather than the CV. How many people were reporting in, what was their appraisal process, training imparted, growth of dept, SOPs etc. etc.

Having said that, the interview Prabjot gave was especially difficult and the Indian VO, especially curt. This unfortunately is the sad truth with most people working at consulates though. I had a especially difficult time at the Polish consulate yesterday. It's sad these guys hold so much power to influence our futures based on their mood.

Still ... carry on Prabjot, the US then Canada. Or a reappleal maybe. Whatever you want, will come through, it's just slightly delayed.

nano if we talk technically / logically,  regardless that prabjot performed these duties or not if she takes them to court and provide her experience letter written / signed by her manager that she did perform those job duties and if her manager also approves  this statement   then how can a court refuse her.......

courts always consider evidences / written proofs not assumptions made by visa officers / anybody......

so i think her case is strong..................

Hello Prabjot,

It is very rare that an Indian VO will accompany a Candian VO to interview an applicant. It normally happens in Visitor Visa or Family class visa cases wherein the applicant doesn't speak English and the Canadian VO asks for an Indian interpreter. The VO must have got suspicious with some document and perhaps asked for the local staff to accompany. Did they make verification call(s) to your employer? Did they question authenticity of any document? As you can check on these forums, over 90% cases are finalized on "paper based selection" with interviews waived.

I myself being an applicant, fully understand and value your feelings and wish you good luck..
