    I would like to say that i am feb 2007 applicant, if CIC will not request me in coming within 3/4 years,so,
   what will i do? Is it possible?

I wonder, Littigation will be most likely decided in next year. Then what is its useful ness if all the 2004 cases will be clear in 2013? can court decide for monetry loss to litigants besides issuing early PR.

Yes, Court has the power to decide not only damages, in the form of monetary benefits, due to delay in processing of our applications by CIC, but also to order our applications to be processed on priority and within a certain timeline.
CIC has to oblige by the judgement of the court, else it'll be contempt of court and CIC will be penalized much more severely.

1.  Federal Court rarely awards damages.
2.  It is quite likely if the cases goes against CIC then it will be then appealed to the Federal Court of Appeal and possibly to the Supreme Court.

Dear Member,

I applied in feb 2007 and my NOC was 1236. I received a letter in 2008 that you are interested or not to migrate CANADA. I replied that actively process my case I want to migrate CANADA. I did not received any  letter or E Mail from CIC to send supporting documents. CIC replied me my mail that we will decide your case after election of fall 2011. I am still waiting now. please reply me... Thanks

Hearing in the court is fixed for 6th of june and decsion will be out by sept 2012. if court insists cic to process backlog cases then you can expect medical in Dec 2012.

But I am still doubtful regarding positive out come of this littigation. If tthe case is so strong in the eyes of court then it should have instruted to cic to start processing backlogged applications and stop taking new one till backlog is clear.let us wait till june 6 and keep your fingers crosssed.
