Friends,
I sent my application to Sydney NS and received the Email last week, today after reading another post in the forum I realised someting regarding Background Declaration - Point 9 (been refused...or any other country...)
I applied for H1B in yesr 2006 through a US based company, with all papers from company and approval letter I went for interview at US Consulate New Delhi, I was given a green document by the Visa Officer which says some additional documents are required from company's side (TAX info etc). After sending the requested documents my H1B visa was refused with reason that the company was not able to give the required documents and is not eligible for sponsering me an H1B visa. My Passport was never taken by Visa office and do not carry any visa refusal stamp.
My Question is should i consider this as YES for the question in Background Declaration - Point 9 (been refused...or any other country...)?
If Yes then Can I make this change now at the time of sending full application, and how will they take it?

Post the exact question. Does it ask about application for 'permanent visa' or any visa?

been refused refugee status in, or an immigrant or permanent resident visa or visitor or temporary resident visa to, Canada or any other country, or have been refused a Certificat de selection du Quebec (CSQ) to Quebec?

pankaj, yes you should mention yes. and make this change right now and explain that you mistakenly overlooked this question at the time of initial application to CIO. im sure this wont harm your application. its better not to hide any such thing.

keeping in mind I have received the email from Sydney NS, should I send this update to Sydney NS or at my local visa office CHC SINGAPORE?
second concern is, at the time of applying H1B, I appliyed with a set of documents containing my previous job appointment letter etc which was very simple one, BUT now I have an updated Job Appointment letter from same company whihc explains a little more about mt role at that time, i got this from my perious company on request. My Question is if I say to CIC that i applied for H1B (given details and reason of refusal) can they check with USCIS (US Consulate) to get a set of my documents to compare/check for clearifications?

In my opinion you should correct it in the forms you will send to your local CHC and attach a note that you have over looked the question, its better to tell them the truth, besides it is not your fault. As your local CHC will verify all the info you provide them. Also all the developed countries including Europe maintains a data base of applicants and their status which is centeralized and any country official can access it by just clicking few keys so its better to save your back before its too late.

I agree 2 with you guys that I should provide this information as it happended and it is the truth as well. I can update this information while sending my full application to my Local CHC, though I would like to know what reason should i write.
The exact reason is, I applied H1B through a very new company, got through the H1B lotarry, for my Petition approved, with documents provided my the company i went for H1b visa Interview at US Consulate New Delhi, Given Green Document which says additional documents required from the Peritionar (Company), got some additional documents from the company (TAX Documents) which were not sufficient as the company couldn't provide the exact documents and project details. Dropped the documents at US Consulate New Delhi, and I received a letter of refusal from US Consulate which has a common text received by so manu H1B refused Candidates on the ground of Comapny is not eligible or can not sponser the candidate as it don't have proper documents and actual job for the candidate in US.
I have this letter with me.
My question is what reason should i provide, giving the above brief with the copy of that letter?
