Hi To All....ung nilaptan na Atty. ng husband ko may isang case siya na hawak na misrepresentation pero medyo malayo ung situation on going pa din aw ung process and almost a year na...ang bayad pala sa Atty namin dun is $250 per hour good thing may office din sila dito.

Ang best option na binigay sa amin is...iwithdraw ung apps ko habang wala pang decision ng VO for "REFUSAL" and my case will be closed na daw...kaya lang the questions i have in mind...ano ang assurance na hindi maapektuhan pa ang husband ko...medyo hindi na din nakapag tanong na asawa ko kze depressed na siya...

So un nga ang sabi is mag withdraw ako then mag apply na lng as skilled...ang magsponsor na lng sa akin is ung ate niya or kahit sino sa mga kapatid niya...

Another question I have in mind is that...hindi kaya iisipin ni VO na kaya ko winithdraw is "GUILTY" kami? or better na sumagot pa din sa kanila and submit all the evidences pero ang decision namin is to wthidraw of my apps pa din? Kze gusto ko lang mainformed at maiparating sa VO na it was my mistake and due to limitation of my knowledge of what cohabiting is all about kaya nagkamali ako. Admitting my mistake is not a "SERIOUS CRIME", wherein hindi naman ako pumatay ng tao, hindi ako nagnakaw, hindi naman ako nakasakit ng iba, wala akong niloloko at higit sa lahat "TOTOO" lang naman ang sinasabi ko na hindi ko naman talaga alam kung ano ang provision ng cohabiting at dahil nga during Saturdays and Sundays or if may free time dun ako natutulog sa kanila kaya kinonsider ko na cohabiting...tao lang naman din kze tayo na nagkakamali, may mga bagay na hanggang dun lang ung knowledge and level of understanding natin...pero if pag uusapan if "GENUINE" ung relationship namin...kayang kaya ko na magtestify mga taong nakapaligid sa amin to tell kung ano ang totoo and can also verify to those people...and owners of my previous apartment is willing to cooperate (even dun sa last na condo na nirent ko willing pa siyang magbigay ng photocopy ng ID niya and to give her personal contact number) and certified that I have been their tenant...also sa work din both of my co-Managers and crew and staff are willing to make a statement regarding sa tirahan ko kze minsan kapag late na nagpapatulog ako ng mga crew ko na malalayo pa ang inuuwian and some of them have met my husband as my boyfriend pa before...at meron din naman nakapunta na dito sa Pampanga na Managers and crew ko na nakita nila na dun ako sa bahay ng parents ko nakatira at ung husband ko umuuwi sa kanila...

Ayokong pati husband ko kze is maapektuhan pa...I have to protect him...siya ang bumubuhay sa akin dahil right now wala akong work. And alam ko na in right time ibibigay at igagrant ni Lord lahat kung ano ang the best para sa amin.

Gusto ko lang po sana hingin ang opinion niyo kze mas madami inputs mas maganda.


So i would suggest sa mga katulad ko na naideclare na live-in sila sa application niyo and hindi ka declared as common-law or conjugal ng asawa niyo na ngaun and you think that your application is getting longer na tulad ko umabot ng 9 months and you believe that you are really qualified dahil wala ka ng maisip na iba pang problema except for your declaration na nag live-in kayo, gamit na kayo ng CAIPS at kapag dun sa note ni VO na "FOR CLOSER REVIEW UNG SINASABI NA UNDER CONJUGAL OR COMMON-LAW PARTNER KAYO AND MAY NAKITA KAYO NA 117(9)(D) for review yan" .... "Better to pull-out your application before pa mangyari ung case ko sa inyo or yet wag niyo ng hintayin na mareview pa ng VO na hindi ka declared then declared mo na nag live-in kayo..."SINASABI KO LANG TO PARA HANGGAT MAAARI AT MAS MAAGA PA AND WITH MY CASE I HOPE IT WILL SERVE AS A LESSON TO EVERYONE LALO NA SA MGA MAGSUSUBMIT PA LNG NG APPLICATION NILA...ung bf ng bunsong kapatid ng asawa ko as skilled sya pumasok sa Canada then after 2 months nagpakasal sila duon under skilled sya at was sponsored by the eldest sister of my husband so mas kabisado ng mga kapatid ng husband ko proseso dun (JUST SHARING)... and as much as possible gumamit na kayo ng consultant...kahit na gumastos ka at least sure na tama at makakarating ka ng mas mabilis at walang problema dun...na sana before ganun na ginawa namin...

So..everyone I need your opinion....thank you so much...

sis, did you already sent the documents asked by CEM?  did you sent affidavits stating that you didn`t cohabit with your husband for a year kasi sabi mo nga you only stayed in his parents house during weekends and because of your employment it wasn`t possible that you cohabited for a year prior to your husband`s departure or during his permanent resident application process plus you haven`t combined your affairs (no joint bank accounts, no properties bought together, etc.).  check www.canlii.org because there are lots of cases similar to your case, type in search, 117(9) and you can check what other people did to support their case, unfortunately most of the appeal were dismissed but i just read this case of lozada v canada, their appeal was allowed http://canlii.ca/t/2b1mm

Hi oo nga eh ako na lang yata natira sa atin  yup canadian asawa ko. nasa approval stage na lang daw ako eh queued for review ewan ko sana nga maapprove na kasi malapit na mgexpira medicals ko.

Ermn, Ive been reading your posts and its sad to hear about ur app status ryt now. Bkit po gan2 ang mga tga cem? Gusto lang nman po ntin makapiling ung mahal ntin sa buhay. Sana po maging ok ang lahat, wag kang mag alala kung npag iwanan kna, nde nman po to contest eh. tama sis.alam nyo sa akin tagal din ako naghgintay, 2010 pa ako dapat magprocess but God is in control of everything kahit man gustuhin na natin kung hindi pa time..almost 2years din kami nagkahiwalay asawa ko for many reason.akala ko nga dina maayos ang lahat..so aug 2011 lng naipasok papeles ko and God is really good He answered my prayers.thank God less than 6mos got my visa...just be positive and trust GOD!

tama sis.alam nyo sa akin tagal din ako naghgintay, 2010 pa ako dapat magprocess but God is in control of everything kahit man gustuhin na natin kung hindi pa time..almost 2years din kami nagkahiwalay asawa ko for many reason.akala ko nga dina maayos ang lahat..so aug 2011 lng naipasok papeles ko and God is really good He answered my prayers.thank God less than 6mos got my visa...just be positive and trust GOD!

sa totoo lang nakakapanghina ng loob....kze sa pagkakamali ko na alam ko is sinabi ko lang kung ano ang sa tingin ko un lang naman din...wala naman kaming ibang intention is kung hindi mag start ng buhay namin dun...ngaun ang pakiramdam ko parang nawala lahat ng magagandang plano namin...na hindi naman namin ginusto lahat...nasa work husband ko ngaun pero nagttxt pa din siya worried din siya...kze sa sarili namin alam namin na lahat sinabi ko lang kung ano ang totoo at inaamin ko din naman pagkakamali ko...kanina after niya sa Atty...nag uusap kami umiiyak na siya...sobrang pinipiggilan ko sarili ko...ngaun lang ako nakaiyak at nagkulong ako sa room kinakausap ko si Lord na tulungan kami at bigyan ng enough wisdom para magawa at makapag decide if ano ang dapat and the best na gawin...ang hirap ng malayo sa asawa....lalo na kapag medyo matanda na kayo pareho at gusto niyo maumpisahan buhay niyo...iyak na ako ng iyak...dahil naaawa din ako sa husband ko nasa work siya hindi tuloy makapag concentrate...at wala naman kami ibang hinihiling kung hindi maging maayos buhay namin para makatulong. Ang sakit kze na malaman na ganun pero kung iisipin mo na hindi ka naman pumatay ng tao, hindi ka naman nagnakaw, at wala kang ibang ginawa kung hindi maging honest sa level ng understanding mo...

Hi. Gusto ko lang po i-share yung nabasa ko sa Operational Manual ng CIC for applications processed overseas.

Accompanying family members not excluded

Visa offices may encounter situations where a common-law partner and dependent child of a
sponsor are applying for permanent residence and these individuals were not examined at the
time of the sponsor's own pre-IRPA application for permanent residence. Common-law partners
were not family members pre-IRPA so were not required to be examined. These individuals are
not inadmissible under R117(9)(d). See R355. However, any children of the sponsor who met the
pre-IRPA definition of dependent child should have been examined. If they are now being
sponsored in the family class, then they are inadmissible under R117(9)(d). If, on the other hand,
they are included in the common-law partner's application for permanent residence as
accompanying family members, then they are not being sponsored themselves as members of the
family class but rather are the family members of a member of the family class and hence they are
not inadmissible under R117(9)(d).


I think may laban yung case ni mcm. Kasi nagsama sila before sila nagpakasal which can be categorized as common law during the time na nagapply ang partner nya for permanent residence. Sabi dito, ang common law partner ay hindi family member kaya hindi required na i-examine. Tapos nagpakasal sila. Ang category na nila ngayon ay spouse. To qualify for spousal sponsorship, the principal applicant should meet the definition of a spouse (which is na-meet naman ni mcm) when the application was received by CPC-M. Pwede nilang gamitin ang argument na to para i-prove sa visa officer na 'family member' na sya ngayon under the IRPA.

Pchi you dont need a lawyer to get CAIPS u just need someone living in canada thatcan get it on your behalf
