Attention Required Please!

Hi All,
I got married last month and My husband is in Post graduation Work Permit VISA which is getting expired by Dec, 2011. My dependent VISA got rejected twice.

First time i applied for a (Dependent) Open Work Permit Visa and that got rejected on the ground that the officer was not convinced that i may return back after the authorized period of stay coz of four factors- 1.My travel history, 2.Purpose of Visit,  3.My family ties in CAnada and in the country of residence, 4.Financial status and current employment status. I submitted all my documents and my husband's documents. Since because i was not working i produced the bank statement, Form16, and Payslip of my Father.

Since it got rejected, we consulted a lawyer  @  Canada and as per the guidance offered, after 2 weeks of time i  applied for Visitor VISA. But this time i produced copies of my fixed deposits and almost all possible documents of my in-laws financial statements for financial stability proof.  Also, I specified in the cover letter that this is the first time am going to Canada for sight seeing & touring along with my husband and specified that i will be back after my authorized stay period. I submitted only my Marriage certificate, Birth certificate, financial stability proof, along with all the documents of my husband. Unfortunately , This time also it got rejected for the same reason as before.


I am really confused and feel helpless. Please, Do suggest me what kind of extra documents i need to produce or what should i do exactly next? I have submitted all possible documents when i applied for the first time and second time I produced only the essentials but with very good financial background. I dont understand what went wrong and especially the reasons such as travel history , purpose of visit and family ties  @  canada. Please Help Me to join my husband before his Work Permit expires.

The most important thing to get a TRV is to prove you will leave Canada before the visa expires. You have to show that you or someone who invites you has enough money for the trip expenses as well, but that is not enough.
To prove you will leave: have a return ticket; it is best if you have a job, in which case prove you have a job and get a letter from your boss stating you have been given 2 weeks vacation (or whatever) and that you are expected back; if you are taking some kind of class, provide proof of enrollment, and proof that you have paid for classes that will be starting after your expected date of return from Canada; proof of an apartment lease or mortgage, or that you own property; proof of a bank account and other investments; a very good way to show you will leave Canada is to leave your young child in your home country while you travel. These are just some examples of the kinds of things that will make the visa officer more likely to give you a TRV.
However, if you have family in Canada - especially a spouse - and few or no family in your home country, the visa officer will think you want to stay in Canada, so it is always difficult for a foreigner with a spouse in Canada to get a TRV.

Thnx a lot for ur kind attention.. i will work on that. But, getting inside with visitor visa and then getting work permit from there is possible? will there be any problem for me to get a work permit there (with visitor visa)when my husband applies for a work permit extension for him as well as me? Or can u suggest me some ideas for getting inside with a proper work visa(dependant or individual)? Can i try from some other Province? Please let me know some strategies that which will work out. Thanx a lot for ur concern again. Please do help me further in proceeding with this issue.

Which country are you from ?. From what you say all i can say is this, if you are from a visa needed country to enter canada...

Getting a dependent Visa is very easy, it was rejected due to the fact that his work permit is expiring soon..so once he can get it renewed for 1 more year you should have no problem.

Looks like you are from India, if you apply for a Visitor visa when your hubby is in Canada it's a 95% rejection rate.

I am from India and i got married last month. I applied for open work permit VISA and since it got rejected i applied for a Visitor VISA. So, my first doubt is what kind of VISA i should apply first and how much gap i should give in between for my next application. Second, My hubby will apply for WP extension by this november before which i must be there because when he applies, he can apply for his spouse also who is in TRV. So, I need a visa to enter the country before November. From ur reply, do you mean to say that the possibility of rejection is high as his VISA expiry date is very near? So, Can i apply again for open Work Permit VISA if visitor visa is not apt.? If i get a Visitor VISA Will i have any problem in getting a Work Permit after going there? Is that a good idea? If not for work VISA what next should I do? Does my hubby has any role to play in bringing me there apart from document submission, like producing a kind of recommendation letter from his company or lawyer? Please suggest me. Thanks a lot for ur reply.

If you get a visitor visa, you probably won't be able to get permission to work. When you are in Canada, you can look for a job, but the employer will have to prove to the government that he/she could not find any Canadians or PRs for the job.
If your husband works for a big company, he should ask them for assistance in getting you to Canada as his dependent. A bigger company with many foreign workers will know what to do.
