As a student abroad I don't meet the obligation residency

Hi everyone!
I need to now about how much I risk if I don't meet the residency obligation (the 730 days on 5 years).
I learned a lot about this forum and I understand that the easy  way to renewing my PR is to start the application only when I have the 730 days presence in the past 5 years .
I'm in Canada for the moment bud I am a student abroad and unfortunately I'm not done yet (the reason why I can't wait 730 days). I was  a student at the time  I became a PR in Canada and I was recommended from the officer who interview me to continue my studies and then move to Canada. Now after years my PR is going to expire soon and I understand that I do have a problem. My question is: Is my situation justifiable if I make my application without heaving those days ?

Hi Lilith

I have the exact same problem. I haven't found a definite answer yet. Only thing I know is what I was told by an immigration officer at the airport: that once you come back to Canada and they announce the loss of permanent residency due to lack of stay in Canada, you can appeal the decision. If the judge at the appeal court find the studying abroad argument convincing enough, your PR status would be extended for another 5 years. If you found out anything about our situation please let me know!

No. You will likely lose your PR if you apply with less than 730 days.

I am also in a exact same situation. I'll be applying for a travel document next year. Assuming they will cancel my PR status for overstaying(8 months after the allowed 3 year time), I will reapply for permanent residence as a dependent on my mother(being a full time student for three more years).

nope! I have three more years of study left. And I wish, but no my school is in India.
