Hello SAki/Mitali and others,

This is from another post. Please comment/advise on the same.

My husband has "Power of Attorney" on his name , can we use this as POF along with an affidavit from owner (my mother in law) of land that she will sell this property if we get Canada PR.

Thanks

Satnam

I posted this question to a Canadian Immigration consultant on AllExperts.com about the Property Evaluation as Proof of Settlement Funds.

QUESTION:

Dear Diana,

I am a citizen of Pakistan and also living in Pakistan. I have applied for Canadian Immigration and have got my Initial approval from CIC Canada. I have been advised by the CIC to submit the complete application with all the supporting documents to the Canadian High Commission in London.

My query is about the “Proof of Settlement Funds” requirement.

As per the Instructions guide (IMM EG7000) for Federal Skilled Worker Class on Page 31 it states...

10.Funds
Indicate the amount (in Canadian dollars) of unencumbered, transferable and available funds that you have. This amount can include the value of any property that you own, but should not include jewellery, cars or other personal assets.

In reference to the above statement I will be submitting my property evaluation certificate from a licensed evaluator as an evidence of my Proof of Settlement Funds. I plan to sell my property before landing in Canada and will use the equity to establish myself.

Kindly confirm if the property evaluation as “Proof of settlement funds” satisfies the Canadian High Commission London requirements?

Thanks,

ANSWER:
CIC says : The applicant must clearly demonstrate that they have sufficient and available funds to meet the
requirements.

So, yes property evaluation can demonstrate you have that capacity.

Thanks for your email.

I repeated my question for further clarity

QUESTION:

Thank your for your response.

This means that only Property Evaluation is good enough as long it demonstrate the required funds there is no mandatory requirement to show the settlement funds only in liquid form.

On some Canadian Immigration discussion forums it says that it depends on specific Visa Office whether they accept Property Evaluation as proof of settlement funds. Please advise if this correct, because the CHC checklist specific to London and few others that I have checked asks for the following forms of evidence only, i.e

1.      Current bank certification letter; or
2.      Evidence of savings balance; or
3.      Fixed or time deposit statements.

The checklist  does not mentions about property evaluation can be used to demonstrate as proof of fund.

Kindly clarify this as it would help lot of us who are confused on this issue.

Thank

ANSWER:

I have already answered this question for you once before.

I have more than what is required, but all in the form of Property and I am not in a position to dispose off my Property at this time. I can dispose off my property at the time of leaving for Canada.

There are mixed opinions on different Immigration forums about the Property if it can be shown as the proof of settlement funds. In the guide it does says it can be used as proof of funds but unfortunately the visa office specific checklist is not very elaborative on this. I have checked some visa office specific checklist including London, Pakistan, India and some other and did not see any difference at all under the settlement funds section in each of these checklists. Where in the checklist it is mentioned Property evaluation is acceptable/unacceptable as proof of funds.

Hi Arshad,

Many people have got their Transcripts attested by HEC and it seems that worked for them. I would suggest to request for another set of transcripts from the Univ and in the meantime get the transcript that you have in hand attested. If you are close to 120d submission then go ahead with the attested transcripts or else wait for the Sealed envelope from the Univ.

Previously this was not a big deal but now with all the changes at CIC and the 'apparent' procedure adopted by CIC to weed out candidates at the slightest pretext (my opinion),has made candidates more careful about their appication.

Thanks Mitali,i tried to give u another one plus point for good remarks but this forum did not allow me to give you plus one within 168 hours

i believe it depends on the kind of document you are producing as well as visa officer`s assesment....

I was planning to send my complete application to New Delhi Visa office next week. However, my wife's transcripts from SCDL (Symbiosis  College Distance Learning) just arrived and unfortunately those guys had sent it without the university seal on the envelope flaps. This is despite me requesting specifically for it in a cover letter sent to them.
(The saving grace is that it is in their official university envelope and my wife's name and address is clearly printed on the front side).

Does anyone have any suggestions?  what would you guys do in my place- would you send it to the Visa Office like how it is?

Or would you send it back to SCDL and ask for it to be sealed at the flaps? This might result in a delay of 2 weeks to a month as they are excrutiatingly slow.

Regards.

Dear Mitali,  I think no need to submit new forms. If there in no new update in the case of applicant information. As it's clearly mentioned in the Latest updated London VISA office instruction that  :

Hi Friend4u,

I agree... the above was my response to your querry earlier.

Dear Saki,Mitali & all,
I have to ask you some questions for my eligibility points:
1) i am a graduate mech engineer with more than 16 yrs full time study-points to be awrded 20 ( i think sure i will get..)
2)experience-total 10 years of experience but 2 rs exp in FSW NOC so points - 17( 17 to be sure but if other 8 yrs will be considered which is all as per NOC then it should be 21...??)
3)Age-below 40 so sure 10 points.
4)adaptability-wife is having double diploma of 1 yr each and 12 yrs full time study so 3 points and wife's sis in Canada so 5 points-total 8 points sure?!!)
5)IELTS-expecting 14 points as didnt do well in listenening..
so as per the above stats.i should get education-20,language-14,exp-17(minimum),age-10 and adaptability-8 points which makes total 69 points considering which i applied initially....
BTW,my status is-CC got charged and waiting for AOR and in may applicants list..

Now,My questions are:

1) can i be 100% sure of my 69 points?!!
2) if total exp is counted of 10 years( all with NOCs but only 2 yrs in FSW-39 occupation NOCs) then i will get 21 points and then can get 74 points?!!
3) Should i take IELTS again to get 16 points full which i think i can do.. as this time i lost concentration in listenening which may cause only 2 points in listening but R-W-S all went well so hoping total 14 points..
4)in CIC documents mentioned high efficiency in all L,R,W & S-IELTS but will get moderate in listening..should that be ok i fulfill the points requirment?!!

sorry to ask so many questions but if someone can throw some lights on my case pl..

thanx

Regards.

Hi Tilak,

As long as the envelope has not been opened you should be ok.

Hi Laxmi,

If you want a quick answer PM the members who got 2AOR because I think they are now in hibernation period and probably do not check the forum as often as they did earlier.

Just my thoughts...

Hi Nevil,

Congratulations for your CC being charged.....finally its moving.

2)experience-total 10 years of experience but 2 rs exp in FSW NOC so points - 17( 17 to be sure but if other 8 yrs will be considered which is all as per NOC then it should be 21...??)

You will get points for your other jobs if they are in the skill category of O, A or B.

i should get education-20,language-14,exp-17(minimum),age-10 and adaptability-8 points which makes total 69 points considering which i applied initially....

With the current condition you are at 69

Re-taking the IELTS is completely your decision. Irrespective of what you had claimed in your CIO application, now your application will be assessed according to the IELTS score that you provide.

Dear Haral,

I don't think they need new forms to submit Until unless, If their is changes happed in the case of applicant after CIO approval then applicant need to send new forms along with old photocopies.

Its clearly mentioned in the London-V/O Instruction that Before 26th June applicant send Photocopies of forms applied at CIO. If they required new forms they should ask for the new fresh forms to submit In addition, with the Photocopies of forms applied at CIO-N.S.

Well in my case I put my job experience From 2008 05  TO 2010 Till date so no need to update them about more months of time period in the same job.

All we need to ask or search applicants who sent photocopies to London V/O got 2nd-AOR.
