Hello  Smiley,

I have received a positive AEO from my employer in Ottawa. However, I have learned that before applying for the skilled worker application I should submit an IELTS test and I'm required to have good grades to receive more points, so, I'm studying now and it's taking me a while. But, my employer needs me as soon as possible,so my questions are:
1- meanwhile can I apply for the temporary worker and work in Canada, and then apply from there for the PR skilled worker?
2- can my AEO confirmation letter be included in the temporary worker application?
3- Can my employer change the job offer letter and say that he needs me asap while waiting for the PR?

I appreciate your help. Thank you so much in advance.

Basically no.  If the employer wishes you to work before you receive your PR, then s/he is going to have to advertise the position for at least 2 weeks on the job bank.  Then has to apply for an LMO proving to HRSDC that their are no CCs/PRs available for the job and it meets local conditions.  If the LMO is approved, then you can apply for a work permit.

Hi Cynthia,

PMM is absolutely correct.

You are getting mixed up with two different situation here:

1. WP without LMO:

It seems that you are living in Canada (Ottawa) presently....irrespective of your current residential status, your employer has to apply for LMO through HRSDC (as explaned by PMM) and after the receipt of POSITIVE LMO, you could apply for WP at any Canadian Border or from your country of origin ...the processing time for LMO is 4-6 months + 1m (approx for WP). Basically, you can not apply for WP without positive LMO unless your profession is exempt from LMO or you are from LMO exempt country.

He can not have you employed even TEMPORARILY asap without following the above mentioned legal procedures.

2. Affect on PR and AEO application:

Since your employer cannot employ you without positive LMO followed by WP, writing a letter that he will employ you temporarily now and then offering to employ you permanently later as and when you get PR is redundant. Therefore, the offer to hire you now without LMO/WP is null and void. One cannot do that as it is legally not possible and thus you cannot mention this on your PR application.

You cannot work for your employer who provided you the AEO, until you received your PR.

I hope you got the point.

You totally made sense with everything you said. Thank you for pointing this out to me, and you're totally right I cannot mention this on my PR application, as it will complicate many things. I better apply for skilled worker with AEO without mixing everything up.
