Author Topic: Applying while inside Canada, but visitation problems, please help!  (Read 162 times)

Hello,

My husband is coming from England and we were informed that he could apply for permanent residence from outside of Canada while he is visiting me inside of Canada. However due to a lack of funds, were are not able to send the application through as we had planned. We applied to extend his stay a month prior to his departure date(as instructed by the cic . gc .ca website), but didn't received a notice until July saying his application for an extension was denied and stating he lost his status here and must regain it or leave. We applied to have his status restored but have yet to receive any word on the situation. Its now October and we're feeling quite scared an nervous about what can be done.

Should he should stay in Canada and wait/apply when we can? Or should he go back to England and if so, will he be denied entry in to Canada as a visitor or even with an approved application? Will he be less likely to have his application for permanent residence approved because of all this mess?

Please help!

Time to go home immediately. You have been given a chance to depart without enforcement action. You should strongly consider that CIC upon refusal of the extension has passed the decision to the Canada Border Services Agency (CBSA) who may follow up to ensure departure. If it is determined departure has not taken place a report could be written resulting in a removal order and enforcement action. Best to depart and start the process for sponsorship and application for landing from overseas as soon as possible.
