Hi, sorry to hear about your brother. They should and will refund the money. The op manual 6 says about new rules, that if you cannot make to 67 points or your NOC is not under ministerial instructions (not in 29 occupations) , or your application is incomplete, they will not deduct your money...................They deducted mine because my brother's application was complete and my brother was getting 68 points to begin with....... I am not bothered about 1400, but bothered by the UNFAIR refusal....FIRST in my brother's case they lost his application package, when they said they returned it.......last year in july 2010....when I called in october to see what happened to the application they said it was returned because it was incomplete.........it means LOST......i requested them that the application package contained all the original documents, and it will take ages before we are able to collect those docs.....I was told to re apply with the notarized photocopies...which i did in NOVEMBER....by checking this thread , i realized now that the people whose money was deducted in November got POSTIVE/ NEGATIVE eligibility reviews in Feb/ March.....what the hell they were doing to his application till 14th JULY?> Anyway, i will call them and see how it goes....... Hi noolan, the same situation happened with me.
They will not return you $1400 as they have refuse your application, the 1400$ will be refunded ony if your category gets full.
I have also asked for the review and submitted additional documents...
Any update from them?
This was happened on 27 june to me.
i sent doc to them on 5th july and they received on 11th july.
Still waiting for their reply.

When I send my application the CIC guide was not updated and it was asking not to send the Police Clearance certificate. But I ignored that part and I did send my police clearance certificate since it took me several days to get it and when I initially started the guide was asking us to send all documents to CIO.
My police certificate was issued in August 2010. They did not ask me a current one.
The recent letter with MEDICAL REQUEST AND RPRF is clearly saying that they don't need any additional documents and they have waived my INTERVIEW.

Dear friends!
Thanks to everyone who supported and send me their condolences.
Now I Have a happy news.. but still intersting news.
I received a letter on July 21st in my address in Ottawa, Canada which was posted from Fort Erie, Ontario, Canada on 30th June 2011.
Buffalo VO uses Post Box address in Fort Erie, Ontario, Canada to send communications by mail to all IN CANADA applicants. I have used this mail address to renew my visa several times before and BUFFALO VO has inclued this address in their mailing address.
Let me tell you what is the mail that I received after 22 days that is send from same province in Canada.
Mail from Buffalo goes like this.... We have now completed the initial assessment and expect to finalize your application without a pertsonal interview
The letter contains MEDICAL REQUEST FOR ME AND MY SPOUSE and REQUEST FOR RIGHT OF PERMANENT RESIDENCE FEE
Glad to share with you all my happy news.
