What is wrong is that CIC have rules, if bknr has borrowed money, bknr broke the rules and should not have been accepted.
There are clear penalties for this misrepresentation.

If you were applying in the same class as bknr and did not get accepted due to the cap, would you feel the same?
Someone who misrepresented fact would have prevented your legitimate application.


If you are caught by a speed camera driving at 130kph on Monday, is it reasonable to expect to be let off because you drove within the speed limits for the rest of the week, NO.

The rules are there for a reason.

Let me be clear...first of all Proof of Funds doen't apply to me aS i applied in FSW2 category.

What i din't like is the word "Fraudelent"

bknr has borrowed money and proved tht he has finance to support himself.

may be tommorow he will sell his house n pay back the borrwoed amount...wats wrong?

CIC doesnt consider property worth say 1 milion as proof....nor gold worth 1 million...they want it in form of money.

Suppose if i have home and gold and lil cash with me wat shud i do? should i sell it and prove my finance before i get VISA?

even CIC say we should not do that....

guys urnot repaying the bkn borrowed money....why to bother so much


Well fraudulent is the word which exactly describes what bkcnbr and some other applicants have done. So whether you like the word or not, that's what it is.

CIC do allow equity in property to be used as proof of funds at the application stage, which is why they advise you not to sell your home until you get your visa.

But bkcnbr has not done that, he has borrowed money from a company, lied to CIC and even when he lands he will not have repaid the loan and will not have funds of his own.

Of course you are correct, you do not have to have settlement funds if you applied under Category 2 with a job offer. But we're talking about Category 1 applicants.

Let me be clear... borrowing funds and then claiming to CIC that these funds are yours and are unencumbered IS FRAUD.

Well Engy ... I think if they wanted the passports, they would have asked for them ...

But you may think: OK, I have done my medicals and they are OK, they have sent me RPRF, the only thing that is left is the passports request ...

Maybe they are still doing security checks ?

I sent them an email yesterday asking them to let me submit our passports with the fees and they answered me today accepting my request,thanks GOD .

I think Baloo this is a point some people are unable to grasp.

This is not a victimless crime. Every fraudulent applicant who obtains a visa is preventing a genuine applicant from getting one.

Even without the capping system, visa offices can only issue a set number of visas per year, so every fraudulent post-June-2010 applicant is preventing a genuine pre-June-2010 from getting their visa.

I am also thrilled hearing that they have replied to your email that you have sent yesterday.

Did you just send an email on the address mentioned on the embassy's site ? or a case specific inquiry ?

It is also frustrating that they can forget somethings which we have to remind them about !

ok then for me whoever has got PR n go to Canada and reside in different state/city other than mentioned in the application is Fraud....because he/she fills Intention city as so n so and land in other diferent city and stay there .

and also all the ones who got PR and actually doesnt reside in Canada n stay in their home country or country of residence n visit canada once in a while are also not good as well. They are not contibutng anything to Canadian govt..n moreover because of this kind of people the real genuine potential applicants are loosing their chance for applying PR due to CAP system

If it's in Canadian dollars, it's the Receiver General for Canada.

Sometimes visa offices allow local currency in which case the payee will be different, but you'll have to check with your visa office.

Simplest way is Canadian dollars then it's definitely the Receiver General for Canada! Smiley

Well, the entire thing he did was wrong. Or else he would have declared it to CIC. Wayne, In India we are used to getting things done by slipping a few quid below the table. People get used to this and the process gets accepted as part of life as this "under the table" is required at almost every part of the system. That doesnt make illegal thing legal. What is illegal is fraudulent.

I understand different cultures have different levels of acceptability.

But as you say CIC has only 1 level of acceptability - those who are eligible, and those who are not. Those who do not have sufficient unencumbered settlement funds are not eligible, simple as.

As also as I have pointed out, each of these fraudulent applicants who gets a visa is preventing a genuine applicant from obtaining one.

They won't request passports until the medical services division of the visa office have received and approved the medical results, and the visa office has received RPRF. But I see no reason not to send the RPRF immediately, they you know the RPRF will not be the cause of further delays.

There is no requirement to lived in any particular province in Canada if you apply under the Federal Skilled Worker route. You are only required to live in a certain province if you apply under Provincial Nomination. So that is not fraud.

There is no requirement to stay in Canada once you have landed. You can stay in your own country and let it expire after 5 years. But you will have to re-apply if you ever want to live and work in Canada again. So that is not fraud either.

There is not a requirement to even land, you can let your visa expire after 1 year from the date of your medicals. But once again you will have to re-apply if you ever want to live and work in Canada again. But that is not fraud either.

So please stop trying to justify this lying and cheating that some people are doing by borrowing money and pretending it is theirs with other made-up instances of fraud, which are not.
