Author Topic: Application Refused due to "Non-Compliance  (Read 673 times)

I have applied under old system (year 2006). Documents updated in December 2008. Later CIC London asked for original degree and transcripts, that my consultant couriered in July 2009. Soon after that, my eCAS changed from "IN PROCESS" to "DECISION MADE".

My consultant sent several e-mails since then requesting CIC for an update of the case after original degree sent, but no response from CIC as at now.

Today I received my CAIPS notes which reveales IO comments that no orginal documents received despite 3 reqeusts, hence application is refused based on "non-compliance". Though my score as per CAIPS notes is 74.

Please advise me how I can assure CIC that original documents had been sent upon their request. Bearing in mind that the envelop that my consultatnt couriered, contained other clients' documents as well, not just mine.

By the way, so far no refusal/other letter received from CIC.ndly advise.

If you do not belong to the 38 list, ask your consultant to file for an appeal as soon as possible. There is a time limit for the appeal to be entertained from the time a decision was made. I suppose your consultant knows best about this. But if your profession is in the 38 list, submit a new application, it will be faster than the process of your old application.

My NOC as per CAIPS notes is 0121, which I think does not fall under list of 38. So I cannot re-apply. I have not yet received any letter from CIC regarding refusal of case or otherwise. This only became known when I received my CAIPS notes that a negative decision has been made. The cut-off date of CAIPS file is 1st September, which means I am totally unaware of any developments, if any, between Sept 2 and now.

Anyways, I am going to see my consultant today to request to forward a copy of the letter that they had earlier sent to CIC wiith which they had attached original degree.

In the meantime, I will try to obtain duplicate copy of degree from my University, assuming that original is already misplaced at CIC.

Nonethless, may I request any comments from seniors and other members.

If you sent the documents to cic by courier then you must have a receipt and delivery report. Trace it and send it asap. As you do not fall within the new 38 list you will have to convince cic that you did comply with their request. Offer to send the documents again if they cannot trace the ones you have sent.

Immediately contact CIC advising them you have sent originals or will be sending.

You said that the consultant claims to have sent them with a bunch of other applications.  CIC/CHC claims they didn't receive them wrote to you or your consultant on three occasions.  Didn't your consultant reply?  I wouldn't hold out much hope that they will reconsider.

  Hi Aamee,
                At t his point in time, if i were you and can trace the receipt of the mail that was sent then, you should scan it and send it to them by  e. mails and photocopy it and send also by Express mail.

At the same time you should also be trying to get another copy of transcripts in case they ask you to send as soon as possible  then you do that.

If i were you that is what i will do as soon as possible. No delays.

Just now my consultant received an e-mail from CHC confirming receipt of original documents.

I think I have to wait for some time now. Do you guys agree with me?
