Author Topic: Application for residency in USA and CANADA  (Read 340 times)

I am a Filipino. I have a pending application for US as an employment based immigrant but because of retrogression I decided to apply for permanent resident in Canada. I am afraid that my two applications will be decided in the coming months. My questions are:

1. Is it legal to have two permanent residency stickers in my passport? What will happen if my US application approves first and I got the residency sticker for it. Will Canadian embassy provide me permanent residency sticker once my application got approved even if in my passport has the US PR sticker?
2. Can I keep my PR in both countries? Is it legal to cross the borders just to keep my PR in both countries? What should I tell to the immigration officers in the borders if they will ask me why I have two PR stickers in my passport?

The fact is I have a two year contract in US, in my mind I just want to complete it then permanently reside in Canada.

3. How can I maintain my PR in Canada eventhough I am working in US for two years?

I really need all the advices that I can get from all of you. Thank you in advance.

The Canadian PR Visa ( you mean sticker ) will be put on your passport only after approval of your  submitted PR application.
To keep your status as a permanent resident, you must live in Canada for at least two years within a five-year period i.e minimum of 730 days physical presence in Canada at the 5-year mark. If you can maintain these required days of presence in Canada while your stay in US or after your job assignment, it would be fine.

I am not aware of the rules in US related to PR / Green Card.

Thank you for your reply sir wilson. But my major concern is, if it is possible and legal to have two (2) permanent resident stickers in my passport? Will Canada allow it?

I don't think Canada will be reluctant  to put PR visa sticker to your passport for the reason that your passport already have a US visa sticker. The stickers are not the issue. There could be several other countries stickers also ( some people do have ) in a passport.
