I applied under FSW 2 but was processed under FSW 3. I lost my job while in Canada, so I asked to be processed under FSW 3 since I qualified as a student.  I was in Canada during the entire processing period (except for short vacations back to my home country).

My timeline is as follows:

Mine was rejected, buffalo transfered my file to LA and they rejected it saying I have not performed duties under an older job.  but I had applied under FSW3 (with my current job in Canada and that I was an international student in canada too).  I had sent them a fax informing them of this and they have not gotten back to me.  Now I am on the look out for a good immigration lawyer in Edmonton, if anyone knows of one please let me know.
