I have a friend who is going to re-apply under the FSW NOC stream. He applied in MI-3 under the NOC 1122 – Professional Occupations in Business Services to Management. Unfortunately, quota was filled very fast and his application was returned. He wants to reapply under the same NOC in July 2012, if the NOC list doesn't change. Other than this he has never applied for Canadian visa of any kind.
My question to you is, in Schedule A Background/Declaration form, there is a question number 6, which requires a Yes/No answer.
6(d) been refused refugee status, an immigrant or permanent resident visa or visitor or temporary resident visa to Canada or any other country?
6(e) been refused admission to, or ordered to leave, Canada or any other country?
What should he write for these questions? I mean he did apply before but the application was not processed as quota was filled, so is it still considered as a refusal, and should he check the answer to both questions as 'Yes'?
Further more, if he choses 'Yes', then how should he explain it in the details section of question number 6.

You see refusal and rejection are almost same but there is a basic difference in application in the Canadian immigration. Here you go:
can be because the application was not complete and you met the requirements
, so you could re-submit. Whereas if your application was complete and it was refused
, because it didn't meet the requirements.
In your friend's case, his application was either complete or not but was returned due to CAP reached
, not rejected or refused
. In this case, s/he should not tick YES .
This is totally from my personal view, you can also write to Qorax, PMM, LEON, Dr. Hasib, Ahsan1289 to be more sure.
