AINP Filling - Legally Not Separated

I'm reday to applyfor AINP program but not sure how should answer few questions:

Scenario:
- On H1B for last 4-5 Yrs.
- Got married last yr, spouse on H4.
- Spouse not living together for last 4 months but I haven't filed legal seperation so she can get her H1B without any complications.
- Spouse in the process or getting H1B or she already got it so she is not willing to sign any document.
- Want to file for AINP asap because my H1B is running out.

What should I put in section D - as she is not accompaning me with but all her details and pictures are required along with her signature.
Also, what should I put in for Question 9 of Imm 008?
