IMO, for both who applied before and after 2/19, one has to be on H1 status till the nomination is received. But the CIC process can be continued from the home country in case becomes out of status after receiving the nomination.

Ell.Bee

Can you clarify where did you get that before 2/19 applicants need to be on H1 at time of nomination. I have an email from AINP which says before 2/19 applicants don't have to be so...

Could u provide some link, etc...

I dont have any link or anything. Someone had asked this question in the Webinar which I attended on 14th Jan and they said the same out there. I guess you need to call them and check. Or ask to others in the forum.

You must be currently working in the United States and possess a valid visa in one of the following
temporary skilled worker visa categories: H1-B, H1-B1, H-1C, E-3 at the time the AINP makes a final decision on the application;

Good day;

The rules prior to Feb 19, are that a candidate is eligible as long as they meet the requirements at the time of application.

For applications after Feb 19, your will still need to meet the eligibility requirements at the time a final decision is made regarding nomination – meaning
Your H1-B visa needs to current and valid and you need to be legally working at the time of final decision by the AINP.
You are always required to notify the AINP of any changes of employment conditions or change of address if your situation changes following nomination by the AINP.

Any changes to your status or contact information can be emailed to us, please reference your name, address and birth date, and file reference number if you have one.

either way, you never know what they come up with when they look at the application. They are the ultimate power here with NO APPEAL PROCESS. I am myself laid off so bit concerned.

DUDE, Y R U POSTING UR QUESTION 'N' NUMBER OF TIMES.... ITS SO IRRITATING

Guys,
Do you know any IT companies in USA that are able to sponsor for H1 B visa from other majors such as Chemist, Mechanic Eng, Chem Eng, etc?
Thank you for your advice. I look forward to hearing from you all .
Regards,
Yo

IAlberta: I think it's OK. Yofei seriously wants a job soon it seems. LEt's help if we can.

Yofei: Yes, there must be many who can sponsor from other majors. But USCIS may send RFE/query these times for IT employees with different background and be prepared for that.

So not many companies may come forward to sponsor and take all these hassle. But who knows. Good luck.

Getting approval notice from USCIS has become tough and whoever are doing H1 transfers are put on query or getting denial notices. One such case I have seen yesterday and the company terminated the guy because of H1 transfer denial notices based on educational background.
I think risk is involved and I guess better to have it done using premium processing to at least know its result or don't do it at all. If the result is not positive you can continue on existing H1 and do AINP process from Home Country. The guy who put H1 transfer using normal process 6months back got denial notice yesterday and because of this his status has become illegal now as his previous employer had already revoked his H1.

Think wisely and proceed... I guess wait until get nomination and do AINP-CIC process from home country would be better option rather then with "NO H1-status" because of H1 transfer denial notice or query after 3-4 months.

Hi,

One thing you must consider is calling the State Police Department before applying for PCC. And I am glad I did that with GA. Police Department in GA does not accept the FBI fingerprinting card which can be downloaded from the FBI website. The reason given to me is that they cannot use them in their FP reading machine. I was told that I will need to go to local Sheriff Office to obtain them. But keep in mind not always the Sheriff Office is willing to give them out. In that case you can request GA Police to post them to you. I got them in 3 days. I have not yet applied for State PPC as I will wait for the nomination to come or they might get invalid.

For more information on PCC for GA, please call Marina at 404-270-8402 or email Marina.Fox @ gbi.ga.gov
