Hi just a quick question.
When applying for my PR application I had forgot to send my work permit application, but send it 3 months after.
The sent me a letter recently stating that I am not eligible.
I was just wondering after the first stage will I be able to work until my PR is complete.

What do you know about your application? Did you send it in July or January of 2010? Either way you should have AIP aka First Stage Approval by now. If you have AIP, you are eligible to apply for an Open Work Permit. The only way I would see that they said you weren't eligible is because you mailed it without the PR application and maybe you didn't state that you would like it attached to your file and would like to be given it upon OWP. Otherwise, they don't know where it belongs and will go ahead and process it before AIP, therefore they would assume you aren't eligible if it isn't attached to your file and they don't know you are awaiting AIP. But yes, after you get AIP and have your OWP, you would get a temporary SIN (which you are eligible to get a permanent one once you have your PR card), and then you would be able to work throughout the rest of the process.
If you could give more information about your process, it would really help.

I got married to a Canadian and applied for a spousal PR.
I sent my application in Jan, and they started processing the app in Feb. Since then I havent been working. Also, in June, I had to come back to the UK for a family emergency, and now looking to go back next month. So just praying that the border agent allows me back through lol.
Im hoping that the 1st stage will be done by October, but wasnt sure if I was allowed to work after that stage or allowed to get medical attention if I get injured.
I was just worried that since they said that I was not eligible for a work permit now, that I wouldnt get one after the first stage.

Did you apply in 2010 or 2011? You should have heard back by now about first stage approval already if you applied in 2010. Do you know how to check you application status using e-Cas on the CIC site?

Oh sorry I applied in Jan 2011.
I check on the CIC website using my Client ID Number. Even checking it now it still says in process.
Im hoping it would be done by October as that would be 8 months from the time they started processing it.
Im going back to Canada next month so only have to wait a little while before it gets sorted out.

You realize it isn't recommended to leave Canada during the Inland application process, correct? You should hear about first stage approval 9-10 months after your application was received by Vegreville. If you didn't send your OWP with the PR application then you are going to have to wait to apply for it AFTER you receive AIP. The reason they said you aren't eligible is because they processed it SEPARATELY from your PR application and as of right now in your application, you aren't eligible because you don't have AIP yet. That's why it is recommended to send it with the application so it doesn't get lost or get confused on what to do with it and they process it right after AIP for you. Just be sure during the application process to keep your visitor status valid by extending your stay and have it "received" by Vegreville before it expires. Get tracking on it. Then after you receive AIP, you can apply for the OWP and will be eligible. Once you get your OWP you can obtain a temporary SIN and then work during the rest of the process.

Yea I only realised that like a few weeks ago. My only reason for coming back to the UK was that my mum was diagnosed with breast cancer. So im hoping that the border agent will let me back into Canada.

They do follow criteria, but as always they have the final say. There is no single "normal reason" why someone would be refused entry. BTW The duration of your stay can be limited by the IO.

Do u know what criteria they have to follow by any chance.
Sorry im just nervous of getting refused and getting sent back to the UK. I really dont want my application to be closed and having to re do everything.
I was thinking of booking a 2 or 3 month return ticket. U think that will be ok?
also, what proof would i need to show the IO of my PR?

hi there,
dont worry too much. i am a inland applicant (quebec). and i noticed they highly recommend not to leave Canada. however, i went to france for 3 months, coz of my father-in-law. and also went back to hometown (hongkong) for 1 month... i have no problem at all passing the custom.
sending u lucks in the application. i have been waiting 10months already, got the CSQ and i know it's homestretch!

Wow u dont know happy I am to hear that. Ive been worried, and stressing about this everyday.
And my PR application is already 6 months in and I really didnt want to start it over again.
I cant wait to leave and go back to Canada.
