Adoptability points

Dear Qorx,

               My total points are just falling short by ONE only. My wife's real brother is PR holder and at present residing in Toranto. He is studying there for full time on OSAP (Ontario Student Assistance Programe). Accrding to rules he can not take any employment as he is assisted by OSAP for ful time programe. Now according to advise of my consultant some tax deduction evidence should be produced.
               
               You are requested to help me find a solution as to how I claim these critical and deciding points. He has PR, has accommodatiom, studies there but does not earn.

Hi if you are the Principal applicant then you cannot claim 5 points for adaptability but if your wise is the principal applicant then she can

EDIT: I agree with PMM below, that it can be either the PA or accompanying spouse relatives as well. But QORAX's point is also relevant.

Sorry, you are wrong.  From the OP 06 manual

d) Relatives in Canada:
 Award five points if the applicant or accompanying spouse or common- law
partner has a relative (parent, grandparent, child, grandchild, child of a
parent, child of a grandparent, or grandchild of a parent) who is residing in
Canada and is a Canadian citizen or permanent resident.

Though not clarified anywhere, a requirement of the 'relative' is to "support u financially" till the time u guys r up-n-going. Which is why those points r awarded under IRPA. since your relative is a student (especially under OSAP himself) & isn't employed -- it is unlikely that CIC would give u those points, though he fits the bill otherwise.
