Hello,

It's been almost 12 years since I was charged with importing of a controlled substance.  I'm in the process of sponsoring my spouse to come to Canada.  One of the questions in my applications says "Have you been charged with an offence under act of parliament punishable by a maximum term of imprisonment of at least 10 years".  Does this charge fall under that act?  I'm not sure how to answer that question.

1.  It falls under Controlled Drugs and Substances Act and the importation of Class I , II, III, IV the maximum sentence is life.  See: http://laws-lois.justice.gc.ca/eng/acts/C-38.8/page-3.html  So the answer is yes.

1) No I didn't get a pardon.

2) So your saying it's a definite "yes" on the paper work?  And if so what do I do next?

Also does this mean I can't sponsor my husband right now?

Hey! do your self a favour, hire a lawyer, is about $3500, they take 1000 upfront.
Believe me, i wish i had done so. They Port of Spain office is Bias and will rail road you.

Well I was going to go the lawyer route but I realized that it was going to be a waist of money.  My friend did it and regrets it and said he should of just did it on his own.  My applications is 95% complete, so I just have a few blanks to fill in.  I don't want to give a lawyer so much money to do the same thing I just did.

What if I just got a police record report done and they will see it's been a long time now since it happend and that I have passed the rehabilitation period sine I haven't got into any trouble since do you think that might help?

Find out if u need a pardon as that was 1 of the question on the application.
